YANG BERHORMAT PEHIN ORANG KAYA JOHAN PAHLAWAN DATO SERI SETIA AWANG HAJI ADANAN BIN BEGAWAN PEHIN SIRAJA KHATIB DATO SERI SETIA HAJI MD. YUSOF asks the MENTERI DI JABATAN PERDANA MENTERI to state the extent of the country’s readiness to consider the establishment of a Special Muamalat Court or to introduce a dual reference system between civil and syariah laws to strengthen the Islamic financial system? This is because Islamic finance is under the jurisdiction of the Islamic Banking Order (2008). However, the types of syariah contracts such as Musharakah, Ijarah and Commodity Murabahah practised in Islamic banking are not detailed.

YUSOF, which brings a constructive proposal in improving the financial and legal system in Negara Brunei Darussalam.

ii. Yang Berhormat Pehin’s proposal is well received, however the proposal needs to be researched and examined first in detail for its suitability from all aspects, taking into account that it requires scrutiny of changes to the existing financial and legal systems which also involve changes to the court system.

iii. In this matter, it should also be remembered that taking into account this matter involves court processes which are outside the jurisdiction of this Council, therefore the said proposal is duly noted.
