QUESTION:

YANG BERHORMAT PEHIN ORANG KAYA JOHAN PAHLAWAN DATO SERI SETIA AWANG HAJI ADANAN BIN BEGAWAN PEHIN SIRAJA KHATIB DATO SERI SETIA HAJI MD. YUSOF asks the MINISTER AT THE PRIME MINISTER'S OFFICE to state the readiness of the country in considering the establishment of a Special Muamalat Court or introducing a dual reference system between civil and sharia law to strengthen the Islamic financial system. This is because Islamic finance falls under the Islamic Banking Order (2008). However, types of sharia contracts such as Musharakah, Ijarah, and Commodity Murabahah practiced in Islamic banking are not detailed.

بسم الله الرحمن الرحيم
السلام عليكم ورحمة الله وبركاته

i. Kaola is grateful for the question from Yang Berhormat Pehin Orang Kaya Johan Pahlawan Dato Seri Setia Awang Haji Adanan bin Begawan Pehin Siraja Khatib Dato Seri Setia Haji Md. Yusof who brings a constructive proposal in the improvement of financial and legal systems in Negara Brunei Darussalam.

ii. The proposal from Yang Berhormat Pehin is well-received, but the suggestion needs to be studied and examined in detail from all aspects, considering it requires an examination of changes to the existing financial and legal systems, which also involve changes to the Court system.

iii. In this regard, it should also be remembered that considering this involves Court processes beyond the jurisdiction of this Assembly, the proposal is duly noted.

That is all Kaola can convey. Thank you.
