Yang Berhormat Awang Haji Daud bin Jihan

YANG BERHORMAT AWANG HAJI DAUD BIN JIHAN asks the MINISTER OF DEVELOPMENT to state what monitoring is carried out on damage to small roads used by developers during and after the implementation of development projects. This is in view of the frequent complaints raised by residents and the fact that this situation affects their well-being and comfort.

  • The Ministry of Development, through the application for the Permit to Commence Building Works or Form C under the Building Control Act (Chapter 256), has stipulated the responsibility of the Builder and Qualified Persons in ensuring that public facilities and government property, including small roads, are not affected by the implementation of projects and in repairing any damage arising from their activities by bearing the cost of repair works. Failure to comply with this condition may result in their permit being suspended or revoked.
  • One of the ways of verifying compliance is through the Pre-Construction Survey document submitted by the Qualified Persons in Form C, to determine the original condition of the site and nearby areas, including photographs along the approved access road leading to the construction site before construction works begin. If it is proven that the road damage is caused by the development, the ABCi will issue a written reprimand and carry out monitoring through a Warning Notice.
  • From complaints received in 2024 up to 2025, a total of 93 complaints regarding damaged roads were recorded, namely 55 complaints of damaged roads in residential areas and 38 complaints of damaged roads in commercial areas. A total of 26 complaints of damaged roads have been addressed while the remainder are still under review and monitoring.
  • Beginning December 2024, ABCi has also intensified outreach to Builders for developments that have obtained approval for the Permit to Commence Building Works, where the importance of submitting the Pre-Construction Survey report has been emphasised in order to reduce development-related complaints, especially complaints of damaged roads near construction sites. This outreach was conducted on 2 December 2024 and February 2025 and will continue in September 2025.
