YANG BERHORMAT AWANG LAWI BIN HAJI LAMAT asked the MINISTER OF DEVELOPMENT to state the number of outstanding cases (backlog) involving land transfers and MOTs that have remained pending for years, thereby burdening beneficiaries with legal issues relating to inheritance when the owners pass away. Is the Ministry prepared to set a mandatory maximum time limit for the approval of MOTs?

In situations involving the transfer of land ownership in relation to inherited property when the owner passes away, the matter must first be settled by the relevant beneficiaries or family members in accordance with the legal process stipulated by the Probate Court.

Once an administrator has been agreed upon and confirmed, or lawfully appointed by the Court, the administrator has the authority to manage the inherited property subject to the order or authority granted by the Court.

Therefore, provided that all the required documents are complete and there are no further disputes or legal impediments among the beneficiaries, the process of transferring the land to the rightful beneficiaries can be carried out in a more orderly and smooth manner in accordance with the procedures and provisions of the laws in force.

In the first quarter of the 2026/2027 financial year, 418 applications for land transfers were received by the Land Department, of which 90% received approval within 90 days, that is, from the receipt of the application until approval was obtained.
