With regard to commercial laws, the principle of implementation is through reviews and updates that are normally carried out by the Ministry or Government Department responsible for the relevant commercial laws. This is because the Ministry or Government Department responsible has the expertise and knowledge of the administrative requirements and actual circumstances of the sector. Proposals for identified reviews will subsequently be referred to the Attorney General’s Chambers for legal advice and assessment of the need for appropriate amendments.

In terms of the mechanism for conducting the review, this process normally involves discussions and consultations with the relevant Government agencies. At the same time, the views and feedback of industry representatives and stakeholders will also be taken into consideration to ensure that the review is conducted comprehensively and guided by the actual circumstances.

If necessary, the Government may also establish an inter-agency working team or special committee as a coordinating team to coordinate the review, streamline the policy direction, and assess the implications of implementation before the proposal is referred to the Attorney General’s Chambers for the purpose of drafting or amending legislation.
