YANG BERHORMAT DAYANG HAJAH ROSMAWATTY BINTI HAJI ABDUL MUMIN

QUESTION:

YANG BERHORMAT DAYANG HAJAH ROSMAWATTY BINTI HAJI ABDUL MUMIN asked the MENTERI HAL EHWAL DALAM NEGERI to state the preventive measures for the issue of individuals overstaying in Brunei Darussalam which involve effective enforcement and prevention. Is the issue of overstaying at risk of being exploited by human trafficking syndicates? Considering the country was blacklisted by the United States in 2024, what efforts are being made to avoid being blacklisted again?

YANG BERHORMAT MENTERI HAL EHWAL DALAM NEGERI

ANSWER:

  1. Regarding the issue of human trafficking in Negara Brunei Darussalam, this matter is monitored under the National Anti-Trafficking in Persons Committee (JKAPO) which was established in 2020 and is chaired by Yang Mulia Permanent Secretary (Security and Enforcement), Prime Minister's Office, with membership from the Immigration and National Registration Department and the Labour Department as members.

  2. However, concerning the concern regarding "overstaying at risk of being exploited by human trafficking syndicates" it is not categorized as a human trafficking case where human trafficking is defined as recruitment, transportation, transfer, harboring or receipt of persons for the purpose of exploitation through abduction, abuse of power, deception, forgery, bribery, threat, or coercion under the Anti-Trafficking in Persons Act Chapter 230.

  3. Individuals who overstay in Negara Brunei Darussalam will be subject to enforcement action by the Immigration and National Registration Department such as fines, detention, and deportation under the Immigration Act.
