Your Honourable Members, the sitting of the Legislative Council now resumes and we are still debating Motion No. 5/2026, therefore to continue it I am pleased to invite and give the floor to several more Ahli Yang Berhormat who wish to participate in this debate.
I shall begin by inviting Yang Berhormat Dayang Hajah Rosmawatty binti Haji Abdul Mumin.

Assalamualaikum warahmatullahi wabarakatuh and greetings. Yang Berhormat Yang Di-Pertua, kaola humbly express gratitude for the titah of Kebawah Duli Yang Maha Mulia Paduka Seri Baginda Sultan dan Yang Di-Pertuan Negara Brunei Darussalam which emphasised the need for the drafting of a Code of Ethics and Conduct to ensure that Members of the Legislative Council carry out their trust effectively and with high integrity.
The preparation of this Code of Ethics and Conduct provides an important foundation for the Legislative Council.
In kaola's view, the strength of a code lies not only in the principles stated but also in the extent to which every provision can be understood, referred to and implemented when an actual situation arises. On this basis, kaola support the concept and framework that have been presented.
Kaola and colleagues have carried out detailed scrutiny and analysis of the contents of the framework and found that there are several aspects that can be improved.
Kaola's suggestions are more focused on the implementation aspect so that this code is not only complete as a document but also functions as a clear working guide for all parties.
Kaola also appreciate the opportunity given by Yang Berhormat Yang Di-Pertua to Members to examine the contents of this code and put forward views in this noble Council.

Kaola would like to begin with Clause 1.6 regarding the applicability of the Code of Ethics and Conduct.
This provision needs to give clear meaning between a person's responsibilities while serving as a Member and certain obligations that continue after the end of service.
Clause 10 has already identified the responsibilities of former Members including maintaining confidentiality and not misusing title or position.
In that regard, kaola suggest that Clause 1.6 make direct reference to Clause 10 and state that after the end of service only the specific responsibilities under Clause 10 continue to remain in force.
This clarification will help former Members understand the obligations that must be maintained while providing clearer guidance to the party responsible for implementing the code.
In this way the interests of the Council and the country will continue to be protected through a scope of responsibilities that is stated in an orderly manner.

Kaola next wish to touch on Clause 4 regarding the applicability of the code inside and outside the country.
Kaola view Clause 4 as an affirmation that the trust borne by a Member is not tied to location when carrying out duties or representing the council abroad.
A Member continues to bear responsibility to preserve conduct, the dignity of the council and the good name of the country.
Considering that the principles of ethics and conduct have already been provided for under Clause 3, it may be considered that the contents of Clause 4 be incorporated into Clause 1.6.
That provision could explain that the code applies whether a Member is inside or outside the country when carrying out duties or acting in an official capacity.
This arrangement does not reduce the importance of Clause 4, rather it is intended to bring together the scope of application of the code under one provision so that reference is easier and more orderly, what is of priority is the capacity carried and the trust carried out by a Member.

Kaola next wish to touch on Clause 6 regarding declaration of interest. Kaola note the need for the language in Clause 6.1.2 and Clause 6.1.5 to be aligned so that declaration of interest is clearly established as an obligation.
Kaola's focus is on the procedure that needs to be implemented after that obligation is established. A declaration does not mean that an offence has occurred, rather it is an early step to manage conflicts of interest transparently when personal, financial, business or certain relational interests are directly connected with the matter under consideration.
A uniform procedure will prevent decisions from being made differently for nearly similar situations. At the same time, proper records can protect Members and the council by showing that conflicts or perceived conflicts have been identified and managed consistently while protecting Members and the dignity of the council.

Kaola also wish to draw attention to Clause 11 regarding Enforcement, Complaint Procedures and Disciplinary Action.
Kaola welcome the provision of complaint channels, an initial review process and the establishment of a Board of Investigation when required. This mechanism provides an important basis to ensure that every matter can be handled in an orderly and fair manner.
To complete the process, the procedure for handling complaints may be arranged according to stages that are easy to refer to, beginning from receipt and initial screening of complaints, notification to the Member complained against, an opportunity to provide an explanation, examination of facts and communication of the decision.
A reasonable period for each stage may also be set so that all parties know the course of the process.
For Clause 11.6, kaola suggest that guidance on the membership of the Board of Investigation be detailed. Any member who has an interest or relationship with the matter being investigated should make a declaration and not take part in the investigation concerned.
Kaola also suggest that the term of appointment of board members be stated clearly and that the composition of its membership be reviewed periodically. This step can help ensure that the board always has the balance of experience, authority and capability required in carrying out its responsibilities.

Still under Clause 11. Kaola next wish to touch on the determination of action for a violation. Clause 11.1.2 and Clause 11.2.1 give authority and discretion to Yang Berhormat Yang Di-Pertua in assessing an offence.
Meanwhile, Clause 11.3.3 provides for action in the form of a warning or disciplinary action. Kaola agree with that provision.
To support its implementation, a framework for graduated disciplinary action may be prepared as guidance. This framework may detail the categories and levels of violations as well as the forms of action appropriate by taking into account the seriousness of the offence, its effect, whether it is repeated and any related circumstances.
This guidance does not replace the discretion provided. Rather it provides a more structured basis for consideration so that comparable violations are assessed based on uniform measures and the action imposed is proportionate to the level of the violation.

Next kaola wish to touch on Clause 12 regarding review and amendment of the Code of Ethics. Kaola welcome the provision for this code to be reviewed periodically by the Legislative Council and for any amendments to be tabled through a Motion.
Such a review is important so that the contents of the code remain suitable to current needs and developments.
To ensure that this process can be implemented in an orderly manner, kaola suggest that the review period and the party responsible for coordinating it be stated more clearly. A periodic review, for example, may be considered to be carried out once every two years.
However, an earlier review may also be made if there are changes in law, technological developments and new issues arise that require immediate attention.
The views of Members should also be taken into account based on actual experience throughout the implementation of this code. The results of every review must be presented in this Council. If the review involves amendments to rights, responsibilities or enforcement procedures, the amendments concerned must be debated before being finalised. With a clear period, responsibility and process, the effectiveness of the code can be assessed continuously, and improved based on implementation experience.

Kaola hope that this Code of Ethics and Conduct is not only accepted as a written standard, but truly becomes part of the working culture of the council founded on trust, integrity, accountability and the interests of the people.
With clear guidance as well as fair and consistent implementation, hopefully this code can further strengthen the dignity of the Legislative Council. Therefore, kaola support the concept and framework that have been prepared and hope that the suggestions put forward can be duly considered.
In closing, today's leaders are the example for tomorrow. The people are watching, the younger generation are following.

With the permission of Yang Berhormat Yang Di-Pertua who is wise. Kaola rise to submit an amendment to the Motion that has been tabled, the amendment that kaola propose is as follows:
That the words "RESOLVES that this Code of Ethics and Conduct shall come into force from 26 Safar 1448 corresponding to 10 August 2026, and be adopted by all Members of the Legislative Council" be amended to "RESOLVES that the Draft Code of Ethics and Conduct will be referred to a Committee to examine, refine and submit the Code of Ethics and Conduct to the Council within six months".

On this occasion, kaola would like to explain that this proposed amendment is not intended to reject the noble intention of the government's support to introduce a Code of Ethics and Conduct for Members of the Legislative Council.
Instead, kaola would like to stress that kaola fully support the effort to introduce a Code of Ethics and Conduct that is clear, comprehensive and authoritative in order to strengthen integrity, accountability and public confidence in the institution of the Legislative Council.
Considering that this Code of Ethics and Conduct will become a foundational document outlining the standards of conduct, responsibilities, duties and ethics of Council Members and taking into account several views that have just been expressed by fellow Your Honourable Members, therefore kaola am of the view that it would be good if it could be given more in-depth consideration before being adopted by the council.

Kaola am of the view that this Code of Ethics and Conduct is not merely an administrative document, but a governance document that will become the main reference in determining the standards of conduct of Council Members.
Kaola believe that with a committee, there will be more adequate space and time to examine each provision in detail. Among the matters that can be given attention are the principles of members' ethics and integrity, declaration of interests, conflict of interest, confidentiality of information, complaint procedures, investigation mechanisms, disciplinary action as well as review mechanisms.
In addition, the committee can also obtain views or further explanations from stakeholders such as the Attorney General's Chambers, the Narcotics Control Bureau and other interested parties to ensure that this Code of Ethics and Conduct is truly sound, practical and in line with the laws of the country.

kaola would also like to explain that the draft Code of Ethics and Conduct that has been submitted to the council is not a perfect or final document.
Instead, it has been prepared with sincere intention as an initial proposal to assist the council in beginning discussion on the need to establish a Code of Ethics and Conduct for Members of the Legislative Council.
Kaola acknowledge that this draft may have been prepared based on kaola's examination and understanding of good practices adopted in several other parliaments.
Therefore, it is possible that there are still aspects that can be improved, refined or enhanced.
Kaola also acknowledge that the preparation of the draft still needs much more to go through a comprehensive consultation process, including with Your Honourable Members or the relevant stakeholders.
However, kaola am very honoured that the government has adopted this draft to the extent of supporting it to be brought to this noble Council. Thank you, kaola express, for this trust.
Towards that end, kaola hope this draft can be used as a basic document or working draft to facilitate discussion. It is on that consideration that kaola propose that this draft be referred to a special committee on the Code of Ethics and Conduct of Members of the Legislative Council to be examined comprehensively.
Other Your Honourable Members will have the opportunity to examine each provision more deeply, present views, propose improvements and ensure that the Code of Ethics and Conduct ultimately tabled before the council truly reflects a shared view in accordance with the constitution of the country, the laws in force and good governance practices.
Before that, Yang Berhormat Yang Di-Pertua who is wise. Kaola would like to seek permission regarding several views put forward by those beside kaola here which are very unfounded.
There are some, as presented by Yang Berhormat Menteri Pembangunan this morning, with which kaola strongly agree, that are entirely without basis and also very confusing.
First, this code was received by Your Honourable Members here within a reasonable period as with previous Motions and not within a rather short period to be raised;
Second, when this confidentiality is questioned especially after the term of service. Kaola am disappointed and infer, draw the conclusion that "are you gonna reveal the government secret after your terms end?", that is the question in it.
Kaola am also surprised that there are also Your Honourable Members who are unable to distinguish which is secret and which is not and who further assume that the amendment process, amendment after a code is adopted is more complicated and time-consuming even though sittings are held twice a year. It must also be remembered that this code is not from a corporate perspective but rather government, namely the Legislative Council.
This matter was also referred to the Attorney General's Chambers and the Anti-Corruption Bureau just as the Attorney General's Chambers is the highest department in this country concerning the drafting of laws;
Lastly, this document is not a complete or kaffah document, for the only perfection is the Al-Quran Al-Karim. This Code of Ethics can be reviewed as has been provided for in this code at the end parts whereby, from time to time, we can change it.

In the spirit of deliberation and harmony, kaola respectfully propose that this Motion be amended so that the draft Code of Ethics and Conduct may be referred to a committee to be refined and improved before being resubmitted to the council for consideration and decision.
Kaola hope that Your Honourable Members will give support to this amendment in order to ensure that the Code of Ethics and Conduct to be adopted later truly fulfils the aspirations of the council and becomes a strong, fair document, and capable of serving as guidance to future Members of the Legislative Council.
With that, kaola respectfully request that Your Honourable Members give support to the amendment that kaola have stated. That is all. Thank you.

As the party whom we had originally requested to prepare this draft and to whom we express the highest appreciation, he has brought a proposal that refers to the rules of meeting, namely our Standing Order Section 20 to amend the Motion and thereby submit a proposal to make an amendment to the original Motion which now reads, the original Motion is "RESOLVES that this Code of Ethics and Conduct shall come into force from 20 Safar 1448 corresponding to 10 August 2026 and be adopted by all Members of the Legislative Council" to be replaced with, "RESOLVES that the draft Code of Ethics and Conduct will be referred to a committee to examine, refine and submit the Code of Ethics and Conduct to the council within six months".

After considering the views presented and as I stated at the very beginning in my opening speech that our Council is a consultative council where both sides are heard and in the spirit of the motto from our logo, namely Adil, Laila, Bahagia, therefore I, under the authority vested in me as stated in Meeting Regulation 20 (8), hereby decide to allow the amendment to this Motion to be accepted.

Allow kaola to give my views in the debate on this motion on the draft Code of Ethics and Conduct and on the amendments that have already been submitted.
First of all, kaola would like to record my full support for the motion that has been brought by Yang Berhormat Pehin Datu Lailaraja Mejar Jeneral (B) Dato Paduka Seri Haji Awang Halbi bin Haji Mohd. Yussof, Menteri Penyelaras bagi Keselamatan Negara, Menteri di Jabatan Perdana Menteri dan Menteri Pertahanan II.
Kaola would also like to record support for the amendment just now submitted by Yang Berhormat Pengiran Haji Isa bin Pengiran Haji Aliuddin to refer this draft Code of Ethics and Conduct to a Committee for this matter to be examined and refined more thoroughly within six months.
Kaola wishes to stress that my support for this amendment as stated by Yang Berhormat Pengiran Haji Isa bin Pengiran Haji Aliuddin just now does not in any way mean any reduction in kaola's support for the principles contained in this Code of Ethics and Conduct.
On the contrary, the amendment proposed by Yang Berhormat Pengiran Haji Isa bin Pengiran Haji Aliuddin, in kaola's view, is an appropriate step to ensure that this Code of Ethics is drafted in a more comprehensive, robust and practical manner through further scrutiny by the proposed Committee.
This amendment, in kaola's view, is very much in line with the recommendation of Yang Berhormat Menteri Penyelaras bagi Keselamatan Negara, Menteri di Jabatan Perdana Menteri dan Menteri Pertahanan II himself in his speech last Thursday, where Yang Berhormat Pehin Datu Lailaraja Mejar Jeneral (B) Dato Paduka Seri Haji Awang Halbi bin Haji Mohd. Yussof was also of the view that there should always be room to further refine this draft Code of Ethics and Conduct so that it can be further strengthened from time to time through practical experience as well as input from the Ahli-Ahli Yang Berhormat themselves.
This amendment, in kaola's judgment, is a precise realisation of the recommendation of Yang Berhormat Pehin Datu Lailaraja Mejar Jeneral (B) Dato Paduka Seri Haji Awang Halbi bin Haji Mohd. Yussof.
Kaola also wishes to highlight the argument of Yang Berhormat Menteri Pembangunan just now, that the Provisions on Conduct and Confidentiality in this Code of Ethics and Conduct are not intended to restrict the right to freedom of speech of Ahli-Ahli Yang Berhormat. In fact, it is common practice in legislative bodies throughout the world.
Kaola also agrees that every Member of the Legislative Council should act as the best example in cultivating a culture of debate that is mature, courteous and prudent in line with the defence of the Melayu Islam Beraja philosophy as has been suggested by Yang Berhormat Menteri Pembangunan.
The process of scrutiny by the proposed committee, in kaola's view, is a good opportunity to continue strengthening the balance between the discipline of the House and the right to freedom of speech of Ahli-Ahli Yang Berhormat.
Regarding the concern raised by Yang Berhormat Dayang Chong Chin Yee on procedures for handling confidential information as well as the need for related guidelines and training. Allow kaola to share a view in kaola's capacity as Director of the Internal Security Department.
Kaola would like to inform that the Internal Security Department stands ready and would be pleased to provide briefings and training related to the handling and classification of confidential information to Ahli-Ahli Yang Berhormat if required in order to ensure a clear and uniform understanding regarding the scope as well as the limits of confidentiality referred to in this Code of Ethics. Kaola also wishes to answer the concern raised by Yang Berhormat Awang Haji Salleh Bostaman bin Haji Zainal Abidin regarding the confidentiality provisions in this Code of Ethics.
Kaola wishes to stress that those provisions are not an unfounded restriction, rather they are a fundamental necessity to preserve the long-term interests of the government.
Members of the Legislative Council in carrying out their duties and responsibilities are often given access to sensitive and classified information involving national security and government policies.
These confidentiality provisions, in kaola's judgment, are not only intended to protect the interests of the government but also protect the Ahli-Ahli Yang Berhormat themselves from any undesired implications in line with the provisions set out in the Official Secrets Act, Official Secrets Act.

Kaola would like to add by recalling the Titah of Kebawah Duli Yang Maha Mulia Paduka Seri Baginda Sultan dan Yang Di-Pertuan Negara Brunei Darussalam, namely the Rang Titah Mukadimah of the 92nd Cabinet Ministers' Council Meeting Session, on 15 June 2026, in which His Majesty stressed to the new Cabinet Ministers to always carry out the responsibilities given honestly, with integrity and ethically while together ensuring that the machinery of government is always free from the practices of cronyism, nepotism or any form of abuse of power that may affect the credibility of the government.
His Majesty's Titah, in kaola's view, is highly relevant to the motion being discussed today because cronyism and nepotism, which concerned His Majesty, are among the matters that this Code of Ethics seeks to address directly through the mechanisms of asset declaration, management of conflicts of interest and conduct contained in this Code of Ethics.
Previously, His Majesty had also titah emphasising zero tolerance towards abuse of power and the symptom of corruption while also touching on the importance of integrity, transparency and accountability.
His Majesty's titah have consistently manifested the emphasis that a culture of integrity must be internalised across the whole machinery of government including the Legislative Council as the nation's legislative institution.
Kaola also wishes to relate this motion to Brunei Darussalam's international commitment under the United Nations Convention Against Corruption, or UNCAC for short.
This commitment has been manifested through Brunei Darussalam's significant achievement in the Corruption Perception Index or CPI for 2025 in which the country recorded its best achievement to date, namely the second highest position in the ASEAN region behind only the Republic of Singapore.
In kaola's judgment, the drafting of this Code of Ethics and Conduct for Members of the Legislative Council is not only in line with the country's commitment to UNCAC, but also serves as a testimony to the internalisation of good governance principles that have contributed to the country's improved position in the international index.

Kaola also wishes to touch on a unique challenge faced by Brunei Darussalam as a country with a relatively small population, namely fewer than 500,000 people.
In a small, close-knit and closely interconnected society through family ties, marriage and social relations, it is a fact that the potential to completely avoid any element of conflict of interest is something very challenging, indeed almost impossible to fully achieve.
However, for that very reason, the existence of a clear mechanism such as this Code of Ethics becomes even more important because it is not intended to deny the reality of those relationships but to ensure that whatever form of conflicting interest exists can be identified, managed and aligned transparently so that it does not affect the interests of the country as a whole.
This will show the world that Brunei Darussalam is capable of managing this challenge professionally, maturely and wisely.
This also, in kaola's view, is further proof of the wisdom and far-sighted vision of Kebawah Duli Yang Maha Mulia Paduka Seri Baginda Sultan dan Yang Di Pertuan Negara Brunei Darussalam in recommending the drafting of this Code of Ethics.
His Majesty saw far ahead the need for a formal mechanism to address challenges arising from Brunei Darussalam's unique social structure before related issues become more complex and difficult to address in the future.
Kaola is fully confident in the view that the Legislative Council is the most appropriate platform to begin the implementation of such a Code of Ethics.
That step is hoped to become an example and reference for other institutions in this country whether in the public or private sector in efforts to strengthen as well as cultivate integrity comprehensively.
In that regard, Yang Berhormat Yang Di-Pertua, kaola hereby records my full support for the amendment submitted by Yang Berhormat Pengiran Haji Isa bin Pengiran Haji Aliuddin to refer this draft Code of Ethics and Conduct of Members of the Legislative Council to a committee to be examined and refined more thoroughly while kaola firmly expresses my continued support for the principles of this Code of Ethics as argued by Yang Berhormat Menteri Penyelaras bagi Keselamatan Negara, Menteri di Jabatan Perdana Menteri Dan Menteri Pertahanan II last Thursday and Yang Berhormat Menteri Pembangunan just now.
Kaola calls on Ahli-Ahli Yang Berhormat to jointly give support to this noble motion including the amendment proposed just now.

Your Honourable Members. Kaola am grateful for the opportunity given for kaola to join Your Honourable Members in supporting the Motion proposed by Yang Berhormat Menteri Penyelaras bagi Keselamatan Negara, Menteri di Jabatan Perdana Menteri dan Menteri Pertahanan II regarding the Drafting of the Code of Ethics and Conduct for Members of the Legislative Council and also the Amendment Motion that was proposed by Yang Berhormat Pengiran Haji Isa bin Pengiran Haji Aliuddin earlier.
First of all, kaola would like to convey utmost gratitude before Kehadapan Majlis Kebawah Duli Yang Maha Mulia Paduka Seri Baginda Sultan dan Yang Di-Pertuan Negara Brunei Darussalam for His Majesty's titah which always emphasises the values of integrity, accountability and good governance in the administration of the country.
This proposal is a clear manifestation in translating His Majesty's wish that the institution of the Legislative Council continue to be strengthened as an institution that is respected, trusted and becomes an example to all.
Yang Berhormat Yang Di-Pertua. Public trust in an institution depends not only on the decisions made but also on how those decisions are made and how the individuals entrusted with that responsibility conduct themselves.
In this fast-paced and open era, society not only evaluates what we say in this august Council but also evaluates our behaviour outside the Council.
Therefore, this proposed Code of Ethics and Conduct is most timely because it sets a clear standard regarding the values, principles and behaviour that must be adhered to by every Member of the Legislative Council.
Yang Berhormat Yang Di-Pertua. Kaola strongly support that this code is not intended to find fault with or punish any party, rather it functions as a shared guide in ensuring that every member always makes judgments based on the interests of the nation, not personal interests.
Among the important matters given attention is the need to declare interests and avoid conflicts of interest. In any institution that practises good governance, this principle is the foundation of integrity.
When a member has an interest that may influence his judgment, the matter must be declared transparently so that every decision made does not give rise to negative perception. Even though a member may act honestly, public perception must also be taken into account.
In this regard, transparency becomes the main bulwark for preserving public confidence in the institution of the Legislative Council.
Yang Berhormat Yang Di-Pertua. Regarding the provision on the acceptance of gifts and hospitality as public trustees, every member must always be careful so that any gift or hospitality received cannot be interpreted as having the purpose of influencing judgment or decisions.
Likewise with the use of resources and facilities provided by the government. All facilities given to Members of the Legislative Council are a trust that must be used prudently, with integrity and only for the purpose of carrying out official responsibilities.
In today's digital world, another aspect that is increasingly important is the use of information and social media. As Members of the Legislative Council, we have access to information that is at times sensitive or confidential.
Therefore, the responsibility to maintain the confidentiality of information is very important to protect the interests of the nation and ensure that the policymaking process is not affected. Likewise, in the use of social media, every statement or view shared by Members of the Legislative Council can affect public perception.
Therefore, the use of social media must always reflect the values of courtesy, professionalism and a sense of responsibility as a Member of the Legislative Council.
Yang Berhormat Yang Di-Pertua. Kaola note and welcome that this Code has been prepared through a consultative process with Members of the Legislative Council. This shows that the Code is not something imposed unilaterally, but is formed through the spirit of consultation and mutual consensus.
Kaola also view that the mechanisms for administration, receipt of complaints, investigation and recommendation of disciplinary action as provided are important to ensure that this Code does not merely become a reference document, but can truly be implemented effectively, fairly and consistently.
Nevertheless, in its implementation later, kaola hope that the approach taken will place greater emphasis on the aspects of education, advice and the inculcation of integrity values alongside appropriate action, should any serious violation occur.
Yang Berhormat Yang Di-Pertua. Kaola also wish to touch on the decision that this Code be reviewed periodically. Kaola see this as a very positive step. The world is constantly changing. So too are the challenges faced by public institutions.
New issues such as the use of artificial intelligence, cybersecurity, digital communication and relations with various stakeholders may require improvements to this Code in the future.
Therefore, periodic review will ensure that this Code of Ethics and Conduct remains relevant, practical and meets current needs.
Yang Berhormat Yang Di-Pertua. Kaola believe that the endorsement of this Code of Ethics and Conduct is not merely to fulfil an administrative requirement, but is also a moral and institutional commitment to strengthen the integrity of the Legislative Council. Integrity is not only measured when a person is under observation, but more importantly when that trust is carried out honestly even without supervision.
If every Member of the Legislative Council makes this Code a guide in every action and decision, insya Allah the institution of the Legislative Council will continue to be held in high regard, respected by the people and become an example to other institutions in the country.
Finally, kaola hope that the endorsement of this Code of Ethics and Conduct will become an enduring legacy, not only for the current Members of the Legislative Council, but that it will become guidance for Members of the Legislative Council in the future.
With that, the culture of integrity, accountability, transparency and professionalism will continue to flourish in this institution, thereby strengthening public trust in the Legislative Council as an institution that always upholds the trust and serves for religion, king and country.

In kaola's view, this effort is a very meaningful step in strengthening the integrity, accountability, authority and professionalism of the institution of the Legislative Council. More than merely stating the Conduct of Your Honourable Members, the Drafting of this Code of Ethics carries a greater message, namely the commitment to continue strengthening national institutions so that they always have high standards, integrity and are trusted by the people.

Kaola would also like to relate this matter to the titah of Kebawah Duli Yang Maha Mulia Paduka Seri Baginda Sultan dan Yang Di-Pertuan Negara Brunei Darussalam which always emphasises the importance of good governance, integrity, accountability and public confidence in national institutions.
His Majesty's titah regarding efforts to combat corruption, abuse of power and strengthen governance must be seen as a trust that needs to be translated through actions and practices in every national institution.
Therefore, the Drafting of this Code of Ethics, in kaola's view, is in line with that aspiration. Not because we consider the existing system to be inadequate, but because good institutions must always be ready to improve themselves and raise their standards.
That is the culture that we need to build. This matter is closely linked to Wawasan Brunei 2035, which not only emphasises economic growth, development and technology but also the formation of quality citizens as well as efficient institutions with integrity and good governance.
In this context, the Drafting of the Code of Ethics is a step to strengthen the authority and effectiveness of the Legislative Council. The development of human capital, meanwhile, is not only through knowledge and skills, but also requires the values of integrity, discipline, courtesy and responsibility.
Yang Berhormat Yang Di-Pertua. In kaola's view, the Code of Ethics should also be seen not as a mechanism to find fault with Ahli-Ahli Yang Berhormat, but rather it should serve as guidance for us to carry out our trust better. We are given the freedom to speak, question, criticise and differ in opinion. However, all of it must be grounded in responsibility, courtesy, facts and respect for the institution, with the interests of Negara Brunei Darussalam and the wellbeing of the people always being the priority.

In the context of national development, confidence is also a very important asset. Public confidence in institutions will increase trust in the system of government and government delivery. Likewise, the confidence of investors and the international community in the country's ability to implement good governance will help create a more conducive environment for economic development.
Thus, institutional integrity is not merely a matter of ethics, but also has a relationship with social stability, economic confidence and national progress. That is why institutional strengthening must move in tandem with economic development. Wawasan Brunei 2035 is a vision for future generations.
Every decision and reform that we make today will determine the country that we pass on to future generations. Therefore, the drafting of this Code of Ethics is a form of responsibility to build culture, to build an institutional culture that is courageous in self-assessment, improves weaknesses and constantly raises standards for a better future for the nation.
Yang Berhormat Yang Di-Pertua.
In the end, Wawasan Brunei 2035 will not be achieved merely by building infrastructure, introducing technology or expanding the economy. We need to build quality people and credible institutions. A growing economy without integrity, advanced technology without good governance and development without trusted institutions will struggle to guarantee strong, resilient and sustainable progress. Therefore, kaola support the drafting of this Code of Ethics and Conduct as a step towards strengthening the institution of the Legislative Council and supporting the achievement of Wawasan Brunei 2035.
This is not the final goal, it is the beginning of a better culture, a culture of integrity, trustworthiness, professionalism, accountability, courtesy and responsibility. And ultimately, we want to see a Legislative Council that reflects the country we aspire to through Wawasan Brunei 2035.
A country that is advanced, resilient, has quality citizens, a strong economy, a prosperous life as well as institutions that are authoritative, respected and trusted because in the end national development is not merely about building the future, we must also build people and institutions capable of carrying that future.
With full respect, kaola support the amendment to the drafting of the Code of Ethics and Conduct for Members of the Legislative Council.

Assalamualaikum warahmatullahi wabarakatuh. In the name of Allah, the Most Gracious, the Most Merciful. Yang Berhormat Yang Di-Pertua, first of all, kaola would like to express utmost gratitude before the assembly to Kebawah Duli Yang Maha Mulia Paduka Seri Baginda Sultan dan Yang Di-Pertuan Negara Brunei Darussalam for His Majesty's consent to the drafting of the Code of Ethics and Conduct for Members of the Legislative Council.
Kaola sees His Majesty's consent as a very good and meaningful step in strengthening the trust, integrity, character, discipline and conduct of Ahli-Ahli Yang Berhormat in line with Islamic values and the Malay Islamic Monarchy philosophy which forms the foundation of national life.
Kaola welcomes this Motion and sees the drafting of the Code of Ethics and Conduct as needing to be viewed in the context of our demands and responsibilities as an Islamic country that upholds the harmony, peace and well-being of the people.
As a country based on the Malay Islamic Monarchy philosophy, every institution and individual entrusted with responsibility has the duty to ensure that Islamic values are not only manifested through policies and regulations but are also translated through morals, manners, honesty, justice, trustworthiness and responsibility in carrying out duties.
In the context of the Legislative Council, this matter is very important because Ahli-Ahli Yang Berhormat hold a significant position in carrying the voice of the people, discussing policies and contributing views towards national development.
Therefore, that trust must be carried out with full wisdom, moderation and a sense of responsibility, so that every debate and difference of opinion does not affect social harmony and the stability of the country.
Yang Berhormat Yang Di-Pertua.
Islam itself teaches us to be just, to speak the truth, to uphold trust and to respect fellow human beings. In kaola's view, these noble values are highly relevant in shaping the ethics and character of Members of the Legislative Council.
In this matter, kaola is reminded of several titah of Kebawah Duli Yang Maha Mulia Paduka Seri Baginda Sultan dan Yang Di-Pertuan Negara Brunei Darussalam which often emphasise the importance of calak Brunei as our identity and character, which are reflected among others through being cultured, courteous, respectful of others, proper speech and preserving harmony in social life.
In kaola's view, this calak Brunei is very close to the demands of Islam, as it not only requires us to do what is right, but also teaches us to convey that truth in a good, courteous and prudent manner.
Allah Subhanahu Wata'ala says in Surah An-Nahl verse 125: "Invite to the way of your Lord with wisdom and good advice and argue with them in the best manner". This verse provides a clear finding, that differences of opinion must not separate us from manners and wisdom. We may have different views, but those differences must be conveyed with manners and wisdom.
We may criticise a policy, but criticism must aim to improve, not to bring down. We may point out weaknesses, but such admonition must be based on facts, honesty and the intention of bringing good to the people and the country.
Likewise, Allah Subhanahu Wata'ala reminds us in Surah Al-Hujarat verse 11 that one people should not ridicule another people because it may be that those being ridiculed are better than them. This shows that Islam places great emphasis on honour, dignity and human relations, including when differences of opinion occur. Indeed, Rasulullah Sallallahu Alaihi Wasallam also reminded that a Muslim is one from whose tongue and hands others are safe from harm.
Therefore, in kaola's view, this principle is most appropriate to be absorbed into the conduct of Ahli-Ahli Yang Berhormat, namely that freedom of speech must be accompanied by responsibility, by safeguarding speech, the dignity of the institution and social harmony. These are the values that kaola believes can contribute to the formation of a healthy, mature and harmonious culture of debate.
Yang Berhormat Yang Di-Pertua.
The Code of Ethics and Conduct, in kaola's view, can help ensure that freedom of speech and the right to debate are always balanced with the responsibility to preserve harmony, unity and national stability.
We do not want differences of opinion to become the cause of division; instead, we want differences of opinion to become a source of more mature discussion and to produce better solutions. As a harmonious Islamic country, we also have a responsibility to show the younger generation that differences of opinion are not an excuse to lose respect and that firmness in one's stance does not necessarily require sacrificing manners and courtesy.
What we show in this Council must become an example to society and the younger generation. Therefore, this Code of Ethics and Conduct is not merely a mechanism of behaviour but an instrument for shaping the culture, values and character of Ahli-Ahli Yang Berhormat, so that the institution of the Legislative Council continues to be grounded in manners, integrity, especially harmony, as well as Islamic values and the Malay Islamic Monarchy philosophy.
Yang Berhormat Yang Di-Pertua, ultimately our goal is not merely to have an institution that functions, but an institution that has soul, values and character. An institution that, when seen by the people, gives them confidence and trust. An institution that, when seen by the younger generation, gives them an example of trust, manners and responsibility, and an institution that, when seen by the international community, allows them to see the face of Brunei Darussalam as an Islamic country that is peaceful, harmonious, cultured, full of integrity and upholds humanitarian values as well as shared well-being.
Therefore, kaola sees the drafting of the Code of Ethics and Conduct for Members of the Legislative Council as a very good step in ensuring that the trust, responsibility and character of Ahli-Ahli Yang Berhormat are aligned with the values of a harmonious Islamic nation founded upon manners and morals, and reflect the calak Brunei of which we are proud. With this code of ethics, kaola hopes that it will not only become a guideline on what may and may not be done, but also become a reflection of the character, trust and dignity of every Ahli Yang Berhormat, while continuing to strengthen the authority of the institution of the Legislative Council of Brunei Darussalam.
In this matter, kaola also wish to support the amendment proposed by Yang Berhormat Pengiran Haji Isa bin Pengiran Haji Aliuddin, namely that a period of six months be given to the relevant committee to review and further refine this Code of Ethics and Conduct before it is adopted or officially enforced.

Peace be upon you and Allah’s mercy and blessings, and greetings. Yang Berhormat Yang Di-Pertua and Your Honourable Members, first of all allow kaola to express the highest appreciation and many thanks to Yang Berhormat Yang Di-Pertua for giving kaola the opportunity to discuss and support the Drafting of the Code of Ethics and Conduct Document for Members of the Legislative Council as originally brought by Yang Berhormat Pehin Datu Lailaraja Mejar Jeneral (B) Dato Paduka Seri Haji Awang Halbi bin Haji Mohd. Yussof, Menteri Penyelaras bagi Keselamatan Negara, Menteri di Jabatan Perdana Menteri dan Menteri Pertahanan II, which was amended recently as proposed and which we supported earlier.
Kaola also expresses appreciation and thanks to Yang Berhormat Pehin for his very comprehensive explanation of the Motion presented.
Indeed, the Drafting of the Code of Ethics and Conduct Document for Members of the Legislative Council is in line with the titah of Kebawah Duli Yang Maha Mulia Paduka Seri Baginda Sultan dan Yang Di-Pertuan Negara Brunei Darussalam in this noble Chamber in conjunction with the Official Opening Ceremony of the First Meeting of the 21st Session of the Legislative Council for last year.
Specifically, His Majesty titah on the need for the Drafting of a Code of Ethics for Members of the Legislative Council in carrying out their duties more effectively and with high integrity.
Kaola is of the opinion that the Drafting of the Code of Ethics and the updating of procedures and work processes according to the Legislative Council Regulations, namely the Standing Order, reflects His Majesty’s confidence, trust and high expectations of the role of this Legislative Council as an important platform for the sharing of views between the government and the people in advancing the development agenda, especially in debating major matters that produce a positive impact on the well-being of the people.
Personally, kaola fully uphold this gracious titah of His Majesty and believe, as is also His Majesty’s wish, that the Drafting of this Code of Ethics and Conduct for Ahli-Ahli Yang Berhormat will further enhance the authority and dignity of this Chamber through discussions that are more orderly, focused and continuous.
Because of that, kaola would like to express gratitude for His Majesty’s gracious titah giving priority to preparing a Code of Ethics and Conduct for Members of the Legislative Council, the principles and essence of which are to safeguard the integrity and trust borne by this noble Chamber guided by the members’ moral and professional standard so that it is not tainted by undesirable elements.
In kaola’s view, the Drafting of the Code of Ethics and Conduct for Members of the Legislative Council is a basic framework that serves as guidance to Members of the Legislative Council regarding ethical values, conduct and rules in carrying out their respective responsibilities more effectively, prudently and with integrity.
For that, kaola would like to express many thanks and appreciation to the parties involved in the Department of the Legislative Council for the initiative in drafting this code, which kaola understands was spearheaded by Yang Berhormat Pengiran Haji Isa bin Pengiran Haji Aliuddin.
In kaola’s view, with this code in place it will guide all Ahli-Ahli Yang Berhormat to strengthen the governance, credibility, accountability and professionalism of this Legislative Council. Kaola agrees that in principle the basis of this code is to protect and build public trust between Members of the Legislative Council and the public in line with the Members’ position as holders of a trust of public interest.
This code also has the role of upholding the image and dignity of the institution of the Legislative Council in fulfilling the trust borne, based on loyalty to religion, monarch and nation. The opportunity and responsibility to contribute to the country and the people must be carried out as best as possible with full wisdom and responsibility.
Kaola believe that with the existence of the Code of Ethics and Conduct, it will certainly strengthen the effectiveness of the Chamber and will reflect the maturity and professionalism of Ahli-Ahli Yang Berhormat as intended because it forms part of the official policies and procedures of the Legislative Council that are applied throughout service as a Member, considering that all Members of the Legislative Council are bound by and must always comply with the laws of the country.
Yang Berhormat Yang Di-Pertua. Kaola fully agree with the five main pillars of this Code of Ethics, namely loyalty, integrity, professionalism, transparency and mutual respect. Undivided loyalty to Kehadapan Majlis Kebawah Duli Yang Maha Mulia Paduka Seri Baginda Sultan dan Yang Di-Pertuan Negara Brunei Darussalam as well as the Constitution of Brunei Darussalam and firmly adhering to the Malay Islamic Monarchy philosophy, kaola feel, is the most important element in governing the conduct of Members of the Legislative Council which ought to be preserved at all times wherever we are.
Kaola also fully agree with the responsibilities of Members of the Legislative Council outlined in Clause 2.2 in this Code of Ethics, especially those requiring Members to uphold the principle of collective responsibility, as it requires Members always to act with full accountability, prudence and transparency in order to preserve the integrity of the Council and prioritise the public interest with honesty, trustworthiness, firm adherence to moral principles, always displaying professional qualities, values and skills, and acting with full honesty while practising mutual respect and the spirit of cooperation.
Likewise regarding conflict of interest, conflict interest, contained in Clause 6 of this Code of Ethics, especially that related to the clause on abuse of power and position. Kaola am of the opinion that this clause is in line with and corresponds to the titah of Kebawah Duli Yang Maha Mulia Paduka Seri Baginda Sultan dan Yang Di-Pertuan Negara Brunei Darussalam on 15 June 2026 relating to carrying out the responsibilities given with honesty, integrity and ethics in jointly ensuring that the machinery of government is always free from any form of abuse of power that could affect the credibility of the government.
Likewise in His Majesty’s titah in conjunction with His Majesty’s 80th Birthday Anniversary where His Majesty once again emphasised that there is no place for the symptoms of corruption and dishonesty to occur in society that threaten the well-being and progress of the country. Towards that end, kaola am of the view that Clause 6, 6.1 to 6.4 relating to conflict interest and abuse of power and position found in this Code of Ethics are in accordance with those titah of Kebawah Duli Yang Maha Mulia Paduka Seri Baginda Sultan dan Yang Di-Pertuan Negara Brunei Darussalam.
Kaola positively welcome the drafting of these clauses to uphold this noble Chamber and preserve the integrity and credibility of Members. In closing, in principle kaola fully support the principles and essence of this Code of Ethics and Conduct as guidance for Ahli-Ahli Yang Berhormat in carrying out responsibilities while serving as Members of the Legislative Council.
As a Member of the Legislative Council whether appointed by virtue of office or an Appointed Member, all must hold the trust borne with full wisdom, authority, integrity and high accountability wherever they are, all the more so when carrying out duties abroad.
Towards that end, the Malay Islamic Monarchy philosophy must always be practised by every Member of the Legislative Council in the conduct and social dealings of Members as Bruneians who are full of customs, courtesy and refined manners. Towards that end, kaola support and welcome the proposed amendment made by Yang Berhormat Pengiran Haji Isa bin Pengiran Haji Aliuddin so that this draft Code of Ethics and Conduct will be referred to a committee to examine, refine and submit the Code of Ethics and Conduct to the council within six months.
That is all that kaola can share as kaola’s effort in supporting this Motion and its amendment as well. Kaola pray that Allah Subhanahu Wata'ala will bestow guidance and direction upon all of us in this noble Chamber, open the eyes of the heart and the minds of all Members so that they will positively take this benevolent effort for the common good, not only for our benefit as current Members but also as our legacy for future Members of the Legislative Council, God willing.

Yang Berhormat Yang Di-Pertua. The drafting of this Code of Ethics is an important development in strengthening the institution of the council. This Code sets a clear standard regarding the responsibilities and conduct of Members, where the greatest value lies not only in the standards set but in how those standards will shape the culture and development of this council in the future.
Kaola is of the view that every respected institution has two matters that are always preserved, namely rules and institutional culture. Rules can be drafted within a short period, but culture is only formed through consistent practice over a long period.
In this regard, kaola sees this Code of Ethics as the starting point for the formation of that culture. When a principle is practised continuously, it can eventually become an institutional standard. At that point, Members will no longer need to see the Code of Ethics as a document that must be referred to when questions arise, but as part of the way this institution functions. This is the greater objective that can be achieved through the drafting of this Code of Ethics.
Kaola would also like to touch on the common tendency that when discussing a Code of Ethics, attention is focused on the question of whether an action complies with or breaches the rules. In kaola's view, the responsibility of a Member is far broader than ensuring that an action complies with the rules.
In many situations, a Member is not faced with a choice between something clearly right and something clearly wrong. Instead, Members are often faced with several options, each of which has different implications for the institution, society and the interests of the nation. Therefore, kaola is of the view that the true value of this Code is its ability to strengthen the quality of judgment of Your Honourable Members.
This Code should assist a Yang Berhormat Member to make judgments that are not only valid from the perspective of the rules, but also consistent with the position and responsibility as a Member of the Legislative Council. The greater the trust borne by a Yang Berhormat Member, the greater the need for every decision to be guided by principle and not depend on what is specifically stated in any particular rule.
In addition, kaola also sees that this Code of Ethics opens space for the formation of institutional memory. Membership of the Legislative Council will always change and its Members come from various backgrounds, experiences and fields of expertise, yet the identity of the Legislative Council cannot change according to changes in its membership. Therefore, the experience gained from the implementation of this Code has great value for the Legislative Council.
In kaola's view, every examination of an ethical question, interpretation of the principles contained in the Code and experience gained from its implementation, constitute institutional knowledge that must continue to be preserved. Not to accumulate records regarding a particular case, but to ensure that the principles used by the Legislative Council continue to develop consistently.
With such an approach, Your Honourable Members not only inherit a Code of Ethics, but also inherit the institution's understanding of how those principles can be practised throughout the development of the Legislative Council.
Yang Berhormat Yang Di-Pertua. Kaola also sees that this Code of Ethics has a close relationship with the quality of debate in this Chamber. The quality of a debate also depends on the confidence that every Yang Berhormat Member states his or her position freely, responsibly and guided by the interests of the nation.
When the principles in the Code of Ethics become consistent practice, the public will have greater confidence in the process by which views are formed and decisions are reached. This is important because the authority of the Legislative Council depends not only on the powers provided by the Constitution but also on confidence that every process is carried out according to standards that can be trusted.
Kaola also notes that this Motion provides for periodic review of the Code of Ethics. In kaola's view, such review has greater value than merely updating the contents of the Code. The role of Yang Berhormat Members themselves is increasingly evolving. Yang Berhormat Members not only debate policy in this Chamber but are also increasingly active in inter-parliamentary diplomacy, relations with international organisations, dialogue with the private sector, academic institutions, professional bodies as well as society.
At the same time, technological developments are also changing the way Yang Berhormat Members communicate, manage information and carry out their responsibilities. Therefore, periodic review must become a space for the Legislative Council to assess how the same principles can continue to be applied consistently in circumstances that are constantly changing.
Yang Berhormat Yang Di-Pertua. Kaola also takes note of the amendment that has just been put forward by fellow Yang Berhormat Member Pengiran Haji Isa bin Pengiran Haji Aliuddin, specifically that this draft Code of Ethics and Conduct be referred to a committee to be examined and refined before being resubmitted to the Legislative Council within six months.
In kaola's view, this further examination does not change the main objective of drafting the said Code. On the contrary, that period can provide room to ensure that the principles that have been outlined can be translated through clear procedures, mutually understood and capable of being implemented consistently.
This is also in line with kaola's view that the strength of a Code lies not only in what is written but in how it is understood and ultimately becomes part of institutional culture. Therefore, what is important is that the final outcome is not only a Code that is complete in content but a framework that can be implemented well and remain relevant to the development of the Legislative Council.
Finally, this Code not only sets standards for Yang Berhormat Members but standards that the people can expect from every Yang Berhormat Member. When a Yang Berhormat Member accepts the trust of being appointed to the Legislative Council, society expects that every action, judgment and position taken will always be guided by the interests of the nation, carried out fairly and preserve the dignity of the Legislative Council.
Therefore, this Code is not merely a reference document but a commitment to society regarding the standards that the Legislative Council wishes to uphold. This value is the greatest one brought by this Motion.

Yang Berhormat Yang Di-Pertua and Your Honourable Members. Peace be upon you and the mercy of Allah the Most High and blessings, and good greetings. At the outset, kaola would like to record appreciation to Yang Berhormat Yang Di-Pertua for the opportunity to participate in debating the Motion on the Drafting of the Code of Ethics and Conduct for Members of the Legislative Council in this noble Chamber.
Alhamdulillah, kaola highly uphold the titah of Kebawah Duli Yang Maha Mulia Paduka Seri Baginda Sultan dan Yang Di-Pertuan Negara Brunei Darussalam regarding the need to draft this Code of Ethics as an official guideline to strengthen the governance, integrity and professionalism of Members of the Legislative Council as well as to preserve the image and credibility of the Legislative Council institution so that it functions as an institution fully trusted by the public.
Yang Berhormat Yang Di-Pertua and Your Honourable Members. If we observe carefully, this is the very foundation of leadership in Islam exemplified by Rasulullah Sallallahu Alaihi Wasallam, namely one based on trust, justice, transparency and shura or discussion or consultation.
These values, if we look at them, are not new to us but have long been practised in the administration of the state. Therefore when we debate the Code of Ethics in this noble Chamber, we are actually strengthening a framework that is in line with those leadership values, namely ensuring that every Member of the Legislative Council acts with full integrity, free from conflicts of interest and always preserves the trust of the people through an open and transparent consultative approach.
Yang Berhormat Yang Di-Pertua and Your Honourable Members. Kaola supports the concept and framework of the Code that has been prepared although, in kaola's view, there is still room for it to be refined and further strengthened as a result of kaola's review together with colleagues regarding the draft.
Therefore on this basis, kaola also welcomes and fully supports the Amendment Motion just put forward by Yang Berhormat Pengiran Haji Isa bin Pengiran Haji Aliuddin, to refer this draft Code of Ethics and Conduct to a special committee which will examine, refine and resubmit the Code to the Legislative Council within six months.
Kaola am also confident that the views and suggestions of Members earlier to further refine this code are fundamentally not a sign of rejection but a sign of acceptance and of the Members' determination to ensure that this Council has a code that is truly strong and clear and trusted to function as a protector of the institution's integrity. This proves that this institution is transparent and accepts views to carefully refine every debate so that the implementation of this code later will not cause confusion or injustice in the future.
This also proves the Council's commitment to uphold the noble aspiration of Kebawah Duli Yang Maha Mulia Daduka Seri Baginda Sultan dan Yang Di-Pertuan Negara Brunei Darussalam so that the Legislative Council is always on a path of governance trusted by the people.
Yang Berhormat Yang Di-Pertua. Allow kaola to continue the debate on several matters that kaola have identified from a review of the contents of the draft code provided, although several matters that kaola wish to raise have already been touched on by colleagues earlier, this does not prevent kaola from continuing to debate them with the permission of Yang Berhormat Yang Di-Pertua. Thank you.
For Clause 1 concerning the applicability of the Code of Ethics, kaola support this provision but find an inconsistency in meaning in the provision in Clause 1.6 with Clause 10.
In this matter, kaola also agree with fellow Members who earlier proposed that this provision be updated by limiting the obligation to comply with the code only during the period of service as a Member of the Legislative Council.
As for the period after the end of service, it is clear and has reasonably already been provided for separately in Clause 10. This view also, kaola find, is consistent with the comments from relevant agencies contained in the supporting or reference documents that have been attached.
For Clause 4 concerning Ethics and Conduct at Official Events Abroad, kaola also agree with the proposal that Clause 4 be absorbed into Clause 6 with the emphasis that this code applies to Members wherever they are, carrying out duties or acting in an official capacity whether inside or outside the country.
With this, the provision in Clause 3 will generally encompass the presence of Members in carrying out duties. This guarantees consistent and comprehensive compliance with the law and avoids any conflict of interest as well as abuse of power for personal interest when Members are abroad, particularly those relating to the use and protection of confidential state information.
The trust, integrity and accountability of Members of the Legislative Council must be given priority in order to preserve the image of the Legislative Council and the good name of the country wherever they may be. For Clause 6, kaola refer to the existence of inconsistency in the provisions in Clause 6.1.2 and 6.1.5 which may cause confusion as to whether declaration of financial interests is encouraged or made compulsory for Members. This is also mentioned in the comments from relevant agencies in the reference documents.
In this matter, kaola welcome this provision but am of the view that the declaration of property, assets and any financial interests including share ownership, including those belonging to spouses and children, should be imposed on every Member without condition when a person is appointed as a Member of the Legislative Council, and that this declaration be updated every year or when changes occur that may give rise to a conflict of interest.
The declaration procedure also needs to be clear and simple so that Members do not feel burdened in carrying it out. This transparency is to ensure that the integrity of the Council always remains at the highest level and that public trust in the Members and the institution of the Legislative Council remains preserved.
Yang Berhormat Yang Di-Pertua and Your Honourable Members. On Clause 6.3 concerning Declaration of the Acceptance of Gifts and Souvenirs, kaola welcome this provision, however it needs further clarification so that no misunderstanding arises in its interpretation and to ensure that the integrity of Members and the credibility of the Council are not undermined. Detailed guidance relating to this provision has been submitted by relevant agencies in the reference documents to assess its suitability to the needs of the Council.
Therefore, kaola am of the view that every gift, souvenir or offer of benefit must be recorded and declared to the Legislative Council, whether accepted or rejected, and gifts may only be accepted after approval has been obtained. Meanwhile kaola am also of the view that the giving of cash should be firmly prohibited for every Member.
Yang Berhormat Yang Di-Pertua.
For Clause 9.3 Ethical Use of Social Media, kaola welcome this provision, however it needs to be detailed further because it may lead to subjective interpretation since social media is a space for public discussion and firm views or those that provoke debate do not necessarily violate ethics or the law.
This not only protects Members but also ensures that this transparent and responsible space for public discussion continues to be preserved, that the voices and concerns of the people can be conveyed responsibly and that the implementation of the code does not depend on subjective interpretations from Members and also society.
Yang Berhormat Yang Di-Pertua. Finally, for Clause 11 Enforcement, Complaints Procedures and Disciplinary Action. Kaola welcome the provision of Clause 11 which shows the Council's high commitment to strengthening the integrity and credibility of the institution of the Legislative Council in handling any complaints of code violations through a transparent and fair process.
However, kaola am of the view that the membership of the Board of Inquiry needs to be refined by also involving professional members who are free from any conflict of interest in order to strengthen public trust and protect this institution from perceptions of unfairness in the enforcement process carried out.
A process that is clear and free from the influence of vested interests will protect the complainant and safeguard the rights of the Member complained against as well as ensure that every decision is made with full integrity, transparency, fairness and trustworthiness in line with the position of the institution of the Legislative Council and its Members as bearers of trust in the public interest.
Finally, kaola would also like to suggest that the implementation of this code, once it has been enforced, be accompanied by clear dissemination and appropriate training so that every Member understands the meaning of its contents as well as the procedures for its implementation.

Reprimands, views and improvements are part of a healthy leadership process, not to weaken but to strengthen an institution. Such is our debate. The views put forward are a sign of acceptance and of the Members' determination so that the code that will later be enforced is truly sound, fair and effective.
This is a sign that the institution of the Legislative Council is mature, open to discussion and committed to strengthening integrity for the people and the country.
Therefore, once again kaola stress that these views and suggestions in no way mean rejecting the code but ensuring that this Code of Ethics does not create confusion, does not open room for conflicting interpretations and does not burden Members in its implementation.
It is a collective effort to ensure that this code truly functions as an instrument that strengthens the integrity of the institution of the Legislative Council, preserves justice for all and increases the people's confidence in this institution.
Finally, kaola once again express full support for the Amendment Motion just put forward by Yang Berhormat Pengiran Haji Isa bin Pengiran Haji Aliuddin, to refer this Draft Code of Ethics and Conduct of Members of this Legislative Council to a committee that will examine, refine and resubmit this code to the Council within six months.
Finally, kaola close this debate with these words, values must be understood, justice must be experienced and the people's trust must be preserved. That is the trust that we will bear together, consensus brings blessings.

Assalamualaikum warahmatullahi wabarakatuh and greetings of peace. Alhamdulillah, thank you Yang Berhormat Yang Di-Pertua for giving kaola the opportunity to participate in debating this Motion. First of all, kaola records appreciation for the preparation of the Draft Code of Ethics and Conduct for Members of the Legislative Council for the Council's consideration today.
Kaola supports the effort to introduce this code as an important step in strengthening governance, integrity and public confidence in the institution of the Legislative Council.
Yang Berhormat Yang Di-Pertua.
First of all, kaola would like to touch on the scope of application. In this regard, kaola would also like to record appreciation for the professionalism of Yang Berhormat Pengiran Haji Isa bin Pengiran Haji Aliuddin in proposing amendments to the drafting of this Draft Code of Ethics, taking into account several concerns and suggestions that have been raised by other Members.
Kaola appreciates and supports the proposed amendments and in the same spirit allow kaola also to put forward several views and suggestions for this Council's consideration because as Members of the Legislative Council we are not only responsible for debating national policies, but also bear a public trust. Our conduct and actions always reflect the authority of this institution in the eyes of the people.
Yang Berhormat Yang Di-Pertua, first of all kaola would like to touch on the scope of application of this code after a Member no longer holds office, namely as contained in Clause 1.6. Kaola is of the view that its provision should properly be clarified, as binding a Member to the whole of this code without any time limit may be too broad.
In kaola's opinion, it would be more appropriate if only certain obligations such as confidentiality of information relating to national security continue to remain in force after the end of the term of service. Whereas the other provisions end when a person is no longer a Member.
Yang Berhormat Yang Di-Pertua. Among the matters that kaola very much welcomes is the proposal regarding declaration of interest, declaration of interest in Clause 6.2, because this is an important foundation for transparency and good governance. This declaration is not intended to arouse suspicion against a Member but to protect the integrity of the institution and avoid conflicts of interest.
However, kaola proposes that this declaration be made mandatory without waiting for a request from any party through an annual statement opened by each Member.
In addition to the obligation to notify immediately should there be any material change throughout the term of service.
In addition, the scope of this declaration should also properly be expanded to include the interests of spouses and dependent children. In many circumstances, a conflict of interest does not necessarily occur directly through the Member himself or herself, but can arise through family relationships or parties acting for Members.
If a conflict of interest exists, the Member concerned must make a declaration and withdraw from the relevant consideration or voting and that action should be officially recorded.
In kaola's view, this practice not only protects the integrity of the Member concerned but also preserves the people's confidence in the decision-making process in the Legislative Council.
Yang Berhormat Yang Di-Pertua.
The next matter that kaola wishes to touch on is the acceptance of gifts or tokens under Clause 6.3.
Kaola agrees that Members need to avoid receiving any gifts or benefits that may influence the independence of their judgment or create a conflict of interest.
However, in kaola's view, the existing provision still requires some clarification so that its implementation is more consistent. For example, this code has not clearly set out what the value threshold of a gift is, the time period for making a report, the method of assessing the value of a gift, or how protocol gifts and official gifts are distinguished and managed.
Likewise, it has not been clearly explained whether a gift must be refused, declared, surrendered to a certain party, or may be accepted with the appropriate approval. In the practice of community life, not every giving can be regarded as bribery or an attempt to influence a decision.
For example, at an official event, working visit or courtesy call, there is usually an exchange of souvenirs or tokens of appreciation that are more in the nature of protocol and custom. Likewise, in our community culture, the concept of sedekah, the concept of belanja or treating someone to a meal is often regarded as a form of respect and fellowship.
The question is where is the clear dividing line between reasonable social practice and benefits that can give rise to a conflict of interest.
If this matter is not explained in greater detail, implementation of the code may become inconsistent because each individual's interpretation may differ.
Therefore, kaola proposes that a clearer guideline be created, including applying certain value limits for categories of permitted gifts, gifts requiring approval as well as reporting procedures.
Yang Berhormat Yang Di-Pertua. Kaola also wishes to touch on confidentiality of information under Clause 7, kaola agrees that certain information indeed needs to be protected, particularly that involving national security, state finances or drafts protected by law but not matters related to policy the proposed code is still too general and broad and can give rise to various interpretations.
This code should properly clarify in greater detail the circumstances that permit disclosure, including to whom it may be disclosed, as well as when information is no longer subject to confidentiality.
Therefore, kaola proposes that this code introduce a clearer information classification system including categories of protected information, parties who may receive disclosure as well as the circumstances that permit information to be shared lawfully.
This approach will help protect national interests without reducing our commitment to the principles of transparency and accountability and the appropriate sharing of information.

The development of social media today has changed the way the people interact with leaders, institutions and the government. As members, we also use various social media platforms to connect with society, receive feedback, explain positions and hear the people's views directly.
Therefore, kaola is of the view that this code of ethics needs to ensure there is a balance between the responsibility of safeguarding the good name of the institution and the right of members to voice views responsibly.
In a society that wishes to continue progressing, it is normal when differing views exist, we agree to disagree, however those differences should not be regarded as a threat to the institution, rather, they can enrich the decision-making process and produce better policies.
In that regard, clause 9.3 in this code should not give the impression that every negative, critical or controversial statement on social media constitutes a breach of the code. Action is only appropriate if the statement clearly violates.

First of all, kaola expresses the highest gratitude before the Council to Kebawah Duli Yang Maha Mulia Paduka Seri Baginda Sultan dan Yang Di-Pertuan Negara Brunei Darussalam for His Majesty's command for the drafting of the Code of Ethics and Conduct of Council Members in carrying out duties effectively and with high integrity.
Thank you to Yang Berhormat Pehin Datu Lailaraja Mejar Jeneral (B) Dato Paduka Seri Haji Awang Halbi bin Haji Mohd. Yussof, Menteri Penyelaras bagi Keselamatan Negara, Menteri di Jabatan Perdana Menteri dan Menteri Pertahanan II for presenting the proposed Motion. Kaola is interested in taking part in debating this Motion because it has major implications for the current Members of the Legislative Council as well as those in the future.
As stated, the main purpose of this code is as guidance for Ahli-Ahli Yang Berhormat regarding values, ethics, conduct and rules to strengthen a culture of integrity, professionalism and ethical governance in all affairs of Members of the Legislative Council.
The proposed code of ethics covers ethics and conduct not only during the Legislative Council Session but also for discussions, dialogue sessions, working visits and meetings. And it is not only in terms of the delivery of information and speech but also in terms of attire.
Kaola sees all this as an effort by the Legislative Council to preserve the image of Members of the Legislative Council as representatives of the people who can be trusted to represent the interests of the people, not for personal interests or the interests of one particular group.
With this code, the public will feel confident that every Member of the Legislative Council is governed by the Code of Ethics and Conduct and that every interaction with the public takes place openly without any hidden agenda and that every issue raised will be heard and discussed, and brought to the relevant parties in order to find a solution.
At the same time, the public will place trust in the existence of this Code of Ethics and Conduct, in the credibility of a Member of the Legislative Council, when debating a matter in the Legislative Council, in discussions or dialogue, or when meeting as a Member of the Legislative Council with public officers, as not being known for the symptoms of corruption and will be heard and given attention by any level of the machinery of government.
This is to preserve the image of the Member of the Legislative Council concerned and the integrity of Members of the Legislative Council when dealing with any government party.
Yang Berhormat Yang Di-Pertua.
Members of the Legislative Council must possess commendable qualities to hold this position and with the existence of this Code of Ethics and Conduct it will become a guideline to be complied with not only while serving as a Member of the Legislative Council but also after serving as a Member of the Legislative Council.
On the whole, kaola sees this Code of Ethics and Conduct as complete, however several matters in this code need to be explained, otherwise doubts and differing interpretations will arise.
So in closing, on the whole kaola welcomes this proposed Code of Ethics and Conduct as the conduct of Members of the Legislative Council and for the amendments that will be discussed later.
Kaola is confident that with this Code of Ethics of the Members of the Legislative Council, there will be greater clarity about their responsibilities as the voice of the public and how those problems are conveyed to the authorities to be conveyed back to the public.
